Our litigation focuses not only on defending the claims made by the bank, but by seeking the dismissal and, on occasion, prosecuting counterclaims against the bank for fraud in the mortgage procurement and/or collection process. Ever advance made by the bank is met with resistance in responsive pleadings and with oral argument in court. Further, when applicable, we seek the dismissal of the case based on the bank or their counsel not following relevant Florida and federal statutes.
Our negotiation is geared toward working with the lender to work out a solution. This is most commonly referred to as a loan modification. By completing a modification packet and/or attending mediation, many banks will propose several alternatives to the current mortgage.
